Use of the Website and Services
The Soka Gakkai Malaysia e-Contribution website is maintained by the Persatuan Soka Gakkai Malaysia (‘SGM’) for members who are recorded in SGM Members Database System and would like to make voluntary monetary contribution through on-line banking system in favour of SGM (the “Contributions”). Please read this terms of use agreement (the “Terms of Use”) carefully. By accessing or using this website with links to this terms of use (the “Website”) in any way, including using the services and resources available or enabled via the Website (the “Services”) by SGM or users of the site (the “User”), clicking on the “I accept” button, completing the registration process and/or merely browsing the Website you represent that (1) you have read, understand, and agree to be bound by the terms of use and the standard operating procedure for the use fixed by SGM from time to time, (2) you are of legal age to form a binding contract with SGM, and (3) you have the authority to enter into the terms of use personally.
The term “you” refers to the legal entity identified as the User when you browse the Website or registered on the Website and you individually and personally agree to comply with all terms applicable to such entity. If you do not agree to be bound by the terms of use, you may not access or use this Website or the Services.
Contributions made through the Website and Services are complete final and irrevocable gifts to SGM and are not refundable.
A privacy policy was created that describes our collection, use and disclosure practices regarding any personal information that you provide to us. However, such steps do not guarantee that the Website is invulnerable to all security breaches or immune from viruses, security threats or other vulnerabilities. You may not share information in your bank account or password in order to use the Website or Services with anyone.
If you provide any information that is untrue, inaccurate, not current or incomplete, or SGM has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, SGM has the right to suspend or terminate your Contributions and refuse any and all current or future use of the SGM Properties (or any portion thereof). You agree not to use the Services using a false identity or information, or on behalf of someone other than yourself. SGM reserves the right to remove or reclaim any information at any time and for any reason, including but not limited to, claims by a third party that the information violates the third party’s rights.
You agree not to use the SGM Properties if you have been previously removed by SGM, or if you have been previously banned from any of the SGM Properties.

You are solely responsible for any fees, including Internet connection or mobile fees, that you incur when accessing the SGM Properties.

While SGM reserves the right in its sole discretion to refuse or remove any Content.

SGM and other related graphics, logos, service marks and trade names used on or in connection with the SGM Properties or in connection with the Services are the trademarks of SGM and may not be used without permission in connection with any third-party products or services. Other trademarks, service marks and trade names that may appear on or in the SGM Properties are the property of their respective owners.
Except with respect to Your Content, you agree that you have no right or title in or to any Content that appears on or in the SGM Properties.

User Conduct
You agree that you will not, under any circumstances (except to the extent expressly authorised by the Terms: -
(a) Reproduce, duplicate, copy, sell, trade, resell or exploit for any purpose any portion of the SGM Properties, or access to or use of the SGM Properties;
(b) Upload, post, e-mail, transmit or otherwise make available any unsolicited or unauthorised advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation;
(c) Use the SGM Properties or any part thereof for any purpose, including, but not limited to communicating or facilitating any commercial advertisement or solicitation;
(d) Engage in any chain letters, contests, junk email, pyramid schemes, spamming, surveys or other duplicative or unsolicited messages (commercial or otherwise); or
(e) Market any goods or services for any business purposes.

Unauthorized Use or Access
You agree that you will not, under any circumstances: -
(a) Interfere or attempt to interfere with the proper functioning of the SGM Properties or connect to or use the SGM Properties in any way not expressly permitted by the Terms;
(b) Systematically retrieve data or other content from our SGM Properties to create or compile, directly or indirectly, in single or multiple downloads, a collection, compilation, database, directory or the like, whether by manual methods, through the use of bots, crawlers, spiders, or otherwise;
(c) Use, display, mirror or frame the SGM Properties, or any individual element within the SGM Properties, SGM’s name, any SGM trademark, logo or other proprietary information, or the layout and design of any page or form contained on a page;
(d) Use any unauthorized software that accesses, intercepts, “mines” or otherwise collects information from or through the SGM Properties or that is in transit from or to the SGM Properties;
(e) Intercept, examine or otherwise observe any proprietary communications protocol used by a client, a server or the SGM Properties, whether through the use of a network analyser, packet sniffer or other device;
(f) Bypass any robot exclusion headers or other measures SGM takes to restrict access to the SGM Properties, or use any software, technology or device to send content or messages, scrape, spider or crawl the SGM Properties, or harvest or manipulate data;
(g) Use, facilitate, create, or maintain any unauthorised connection to the SGM Properties, including, but not limited to: (i) any connection to any unauthorised server that emulates, or attempts to emulate, any part of the SGM Properties; or (ii) any connection using programs, tools or software not expressly approved by SGM;
(h) Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for any underlying software or other intellectual property used to provide the SGM Properties, or to obtain any information from the SGM Properties;
(i) Forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the SGM Properties;
(j) Upload, post, e-mail, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment of the SGM Properties;
(k) Solicit or attempt to solicit personal information from other Users of the SGM Properties;
(l) Forge any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting, or in any way use the SGM Properties to send altered, deceptive or false source-identifying information;
(m) Intentionally or unintentionally violate any applicable local, state, national or international law or regulation, or any order of a court; and
(n) Advocate, encourage or assist any third party in doing any of the foregoing activities in this section.

The SGM Properties may contain links to third-party websites (“Third-Party Websites”) and advertisements for third parties (collectively, “Third-Party Websites & Ads”). When you click on a link to a Third-Party Website or Ad, we will not warn you that you have left the SGM Properties and are subject to the terms and conditions (including privacy policies) of another website or destination. Such Third-Party Websites are not under the control of SGM. SGM is not responsible for any Third-Party Websites & Ads. SGM provides these Third-Party Websites & Ads only as a convenience and does not review, approve, monitor, endorse, warrant, or make any representations with respect to Third-Party Websites & Ads, or their products or services. You use all links in Third-Party Websites & Ads at your own risk.

Indemnification
You agree to indemnify and hold SGM, its parents, subsidiaries and affiliates, and their officers, employees, agents, partners and licensors (collectively, the “SGM Parties”) harmless from any losses, costs, liabilities and expenses relating to or arising out of: (a) Your Content; (b) your use of, or inability to use, the SGM Properties; (c) your violation of the Terms; (d) your violation of any rights of another party, including any User; or (e) your violation of any applicable laws, rules or regulations. You agree that the provision of the Terms will survive any termination of your use of the Services, the Terms or your access to the SGM Properties.

Compliance With Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (AMLA) and the Malaysian Anti–Corruption Commission Act 2009 (MACCA)
The User hereby represents declares and confirms that the User is fully aware of the provisions of the AMLA and the User hereby further affirms that all funds used by the User hereto are obtained from legitimate source.
Upon request by SGM, the User hereby agrees and undertakes to execute a due diligence verification of identity form of the AMLA and/or to provide SGM with all relevant documents and/or information to verify, including but not limited to the User’s nature of business, source of funds etc., as may be required by the AMLA or the Appropriate Authority.
Notwithstanding the User’s aforesaid representation, the User hereby agrees and undertakes to indemnify and keep SGM fully indemnified against all claims, costs, damages and expenses which may be brought suffered or incurred by SGM in respect of any contravention of any of the provisions of the AMLA caused by the User.
Meanwhile, the User is fully aware and will comply with all the provisions of the MACCA.

用户在此声明，声明并确认用户完全了解AMLA的规定，并且用户在此还确认用户使用的所有资金均来自合法来源。
根据SGM的要求，用户特此同意并承诺对AMLA身份表进行尽职调查验证和/或向SGM提供所有相关文件和/或信息以进行验证，包括但不限于用户的业务性质，AMLA或相应机构可能要求的资金来源等。
尽管有用户的上述表示，但用户在此同意并承诺由用户引起造成SGM因违反AMLA的任何规定而可能遭受或招致的所有索赔、费用、损害和费用向SGM进行赔偿并保持充分的赔偿。
同时，用户充分了解并将遵守MACCA的所有规定。
Termination
SGM reserves the right to modify, suspend or terminate any Services provided to you at any time for any reason. You agree that all terminations for cause shall be made in SGM’s sole discretion and that SGM shall not be liable to you or any third party for any termination of your use of the Services or your Contribution.
终止
SGM保留随时出于任何原因修改，暂停或终止向您提供的任何服务的权利。您同意，所有原因终止均应由SGM自行决定，并且SGM对您或任何第三方对您对服务或贡献的使用的任何终止概不负责。
Remedies
If SGM becomes aware of any possible violations by you of the Terms, SGM reserves the right to investigate such violations. If, as a result of the investigation, SGM believes that criminal activity has occurred, SGM reserves the right to refer the matter to, and to cooperate with, any and all applicable legal authorities. SGM is entitled to disclose any information or materials on or in the SGM Properties, including Your Content, in SGM’s possession in connection with your use of the SGM Properties.
补救措施
如果SGM意识到您可能违反此条款，则SGM保留调查此类违反行为的权利。如果根据调查结果，SGM认为发生了犯罪活动，SGM保留将问题转交给任何及所有适用法律当局并与之合作的权利。 SGM有权披露SGM产权中与您使用SGM产权有关的任何信息或材料，包括您的内容。
No Subsequent Use
If your ability to access the SGM Properties is discontinued by SGM due to your violation of any portion of the Terms or for conduct otherwise inappropriate for the community, then you agree that you shall not attempt to re-use or access the SGM Properties or any SGM community through use of a different name or otherwise.
没有后续使用
如果由于违反此条款的任何部分或由于其他不适合社区的行为而使SGM中断了您浏览SGM产权或任何SGM网站的能力，那么您同意您不得尝试重复使用或通过使用其他名称或其他方式浏览SGM产权或任何SGM网站。
International Users
The SGM Properties can be accessed from countries around the world and may contain references to Services and Content that are not available in your country. These references do not imply that SGM intends to announce such Services or Content in your country. The SGM Properties are controlled and offered by SGM from its facilities in Malaysia. SGM makes no representations that the SGM Properties are appropriate or available for use in other locations or jurisdictions. Those who access or use the SGM Properties from other jurisdictions do so at their own volition and at their own risk and are responsible for compliance with local law.

General Provisions
The communications between you and SGM use electronic means, whether you visit the SGM Properties or send SGM e-mails, or whether SGM posts notices on the SGM Properties or communicates with you via e-mail.
The Terms, and your rights and obligations hereunder, may not be assigned, subcontracted, delegated or otherwise transferred by you without SGM’s prior written consent, and any attempted assignment, subcontract, delegation, or transfer in violation of the foregoing will be null and void.
SGM shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, pandemic, pestilence, embargos, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor or materials.
Any action brought against SGM or User or any related person shall be brought solely and exclusively in the Court of Law in Malaysia, and that no other court shall have jurisdiction to hear your claims.
These Terms and Conditions shall be construed and enforced in accordance with the laws of Malaysia.
Any waiver or failure to enforce any provision of the Terms on one occasion will not be deemed a waiver of any other provision or of such provision on any other occasion.
If any provision of the Terms is, for any reason, held to be invalid or unenforceable, the other provisions of the Terms will remain enforceable, and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.
The Terms are the final, complete and exclusive agreement of the parties with respect to the subject matter hereof and supersedes and merges all prior discussions between the parties with respect to such subject matter.
In case there is discrepancy in Chinese and English versions, the English version shall prevail.
一般规定
您与SGM之间的通信是通过电子方式进行的，无论您浏览SGM产权或发送SGM电子邮件，还是SGM在SGM产权上发布通知或通过电子邮件与您进行通信。
未经SGM事先书面同意，您不得转让、分包、委托或以其他方式转让此条款以及您在本协议项下的权利和义务，并且任何违反前述规定的企图转让、分包、委托或转让均将无效。
对于因超出其合理控制范围的原因而导致的任何延误或不履行，SGM不承担任何责任，这些原因包括但不限于上帝的行为、战争、恐怖主义、暴动、流行病、瘟疫、封锁、民政或军事当局的行为、火灾、洪水、事故、罢工或运输设施、燃料、能源、人工或材料短缺。
针对SGM或用户或任何相关人员提起的任何诉讼，均应仅在马来西亚的法院进行独家诉讼，并且没有其他法院有权审理您的要求。
此条款和条件应根据马来西亚法律解释和执行。
任何放弃或不执行此条款的任何规定将不被视为放弃任何其他规定或在任何其他情况下的此类规定
如果此条款的任何规定由于任何原因被认为是无效或无法执行的，则此条款的其他规定将保持可执行，并且无效或无法执行的规定将被视为已修改，以便在最大程度上有效并可执行法律允许。
此条款是双方就此主题达成的最终、完整和独自性协议，并取代并合并了各方之间就该主题进行的所有先前讨论。
如此条款的中、英文本出现分歧，则以英文文本为准。
